Brussels, 19 november 2025\u00a0<\/i><\/p>\n

A day before International Children’s Rights Day, a major conference entitled \u201c<\/b>Surrogacy: An Ethical and Political Challenge for Europe<\/b>\u201d was held today at the European Parliament, bringing together Members of the European Parliament, international experts, human rights organisations, and individuals directly affected by surrogacy.<\/b><\/p>\n

The purpose of the event was to examine the ethical, legal, and political implications of surrogacy in Europe and to assess how the European Union can protect the rights of women and children in the face of a rapidly expanding global industry<\/b>.<\/p>\n

A European Event at the Heart of the Institutions<\/b><\/p>\n

The event was organised by Members of the European Parliament Paolo Inselvini, Bert-Jan Ruissen, and Stephen Nikola Bartulica<\/b>. The opening session featured interventions from Laurence Trochu, Jadwiga Wi\u015bniewska, Carlo Fidanza, and Nicola Procaccin<\/b>i, Co-Chair of the ECR Group.<\/p>\n

Italian Leadership<\/b><\/p>\n

One of the most notable remarks came from Eugenia Roccella<\/b>, Italian Minister for Family, Equal Opportunities and Birth Rate, who emphasised the need for a human-rights-based approach rather than one guided by market dynamics or individual desire.<\/p>\n

Italy is today one of the leading nations in the global movement towards the universal abolition of surrogacy.<\/p>\n

The organisation of this conference at the European Parliament reflects this political and legal momentum.<\/p>\n

A Key Intervention from the United Nations<\/b><\/p>\n

The conference welcomed Reem Alsalem<\/b>, United Nations Special Rapporteur on violence against women and girls. She reiterated the conclusions of her recent report to the United Nations General Assembly, in which surrogacy, in all forms, including so-called \u201caltruistic\u201d surrogacy<\/b>, is recognised as a form of violence against women. She called on States to work toward its universal abolition<\/b> through the creation of an international treaty.<\/p>\n

A Rapidly Expanding Global Market: A Critical Challenge for the EU<\/b><\/p>\n

Experts highlighted the exponential growth of the global surrogacy market, valued at 22.4 billion USD in 2024<\/b> and projected to reach 201.8 billion USD by 2034<\/b> (Global Market Insights).<\/p>\n

This expansion currently outpaces legal safeguards and risks creating a de facto transnational recognition of surrogacy contracts through practice rather than democratic decision-making.<\/p>\n

Civil Society Speaks with One Voice<\/b><\/p>\n

The panel brought together organisations from Italy, France, Belgium, Ireland, Croatia, the Netherlands, Spain, and the United States, united in the defence of the fundamental rights of women and children.<\/p>\n

Among them was the Casablanca Experts Group<\/b>, represented by its spokesperson Olivia Maurel<\/b>, herself born through surrogacy, and by its Executive Director, Dr Bernard Garcia<\/b>, legal scholar.<\/p>\n

Speakers shared a principle unanimously affirmed throughout the event:<\/p>\n

\u201cThere is no such thing as a right to a child. But every child has fundamental rights, and these rights are neither negotiable, transferable, nor commercialisable.<\/b>\u201d<\/p>\n

A Clear Call to the European Union<\/b><\/p>\n

Participants urged the EU to:<\/p>\n

\u2022 Ensure that the European Certificate of Parenthood<\/b> does not enable the de facto legalisation of surrogacy in Member States where it is prohibited;<\/p>\n

\u2022 Protect the child\u2019s right to identity, origins, and true parentage<\/b>;<\/p>\n

\u2022 Resist all forms of commodification of the human body and the child<\/b>;<\/p>\n

\u2022 Support the development of a binding international treaty abolishing surrogacy<\/b>, in line with the recommendations of the UN Special Rapporteur.<\/p>\n

A la veille de la journ\u00e9e internationale des droits de l’enfant, une conf\u00e9rence majeure intitul\u00e9e \u00ab <\/b>Surrogacy: An Ethical and Political Challenge for Europe <\/b>\u00bb s\u2019est tenue aujourd\u2019hui au Parlement europ\u00e9en, r\u00e9unissant des d\u00e9put\u00e9s europ\u00e9ens, des experts internationaux, des organisations de d\u00e9fense des droits humains, ainsi que des personnes directement concern\u00e9es par la gestation pour autrui (GPA).<\/b><\/p>\n

L\u2019objectif de cette rencontre \u00e9tait d\u2019analyser les implications \u00e9thiques, juridiques et politiques de la GPA en Europe et d\u2019examiner la mani\u00e8re dont l\u2019Union europ\u00e9enne peut prot\u00e9ger les droits des femmes et des enfants face \u00e0 une industrie mondiale en pleine expansion<\/b>.<\/p>\n

Un \u00e9v\u00e9nement organis\u00e9 au c\u0153ur de l\u2019Europe<\/b><\/p>\n

L\u2019\u00e9v\u00e9nement a \u00e9t\u00e9 organis\u00e9 par les d\u00e9put\u00e9s europ\u00e9ens Paolo Inselvini<\/b>, Bert-Jan Ruissen et Stephen Nikola Bartulica<\/b>. L\u2019Italie est aujourd\u2019hui l\u2019un des pays moteurs du processus visant \u00e0 l\u2019abolition universelle de la GPA.<\/p>\n

La tenue de cette conf\u00e9rence au Parlement europ\u00e9en s\u2019inscrit dans cette dynamique politique et juridique.<\/p>\n

Une intervention majeure des Nations Unies<\/b><\/p>\n

La conf\u00e9rence a \u00e9galement accueilli Reem Alsalem<\/b>, Rapporteuse sp\u00e9ciale des Nations Unies sur les violences faites aux femmes et aux filles. Elle a rappel\u00e9 les conclusions de son rapport pr\u00e9sent\u00e9 lors de la derni\u00e8re Assembl\u00e9e g\u00e9n\u00e9rale des Nations Unies, dans lequel la GPA , dans toutes ses formes, y compris dites \u201caltruistes\u201d,<\/b> est qualifi\u00e9e de forme de violence contre les femmes<\/b>. Elle appelle les \u00c9tats \u00e0 travailler \u00e0 son abolition universelle<\/b> via l\u2019\u00e9laboration d\u2019un trait\u00e9 international.<\/p>\n

Un march\u00e9 en expansion rapide : un d\u00e9fi urgent pour l\u2019Union europ\u00e9enne<\/b><\/p>\n

Les experts ont alert\u00e9 sur la croissance exponentielle de l\u2019industrie mondiale de la GPA, estim\u00e9e \u00e0 22,4 milliards USD en 2024<\/b> et projet\u00e9e \u00e0 201,8 milliards USD en 2034<\/b> (Global Market Insights).<\/p>\n

Cette expansion pr\u00e9c\u00e8de aujourd\u2019hui le cadre juridique et menace d\u2019imposer, par le fait accompli, une reconnaissance transfrontali\u00e8re des contrats de GPA.<\/p>\n

La voix de la soci\u00e9t\u00e9 civile europ\u00e9enne : une unit\u00e9 dans la diversit\u00e9<\/b><\/p>\n

Le panel a rassembl\u00e9 des organisations provenant de plusieurs pays : Italie, France, Belgique, Irlande, Croatie, Pays-Bas, Espagne et \u00c9tats-Unis<\/b>, toutes mobilis\u00e9es pour la d\u00e9fense des droits fondamentaux des femmes et des enfants.<\/p>\n

Parmi elles figurait notamment le Groupe d\u2019experts de Casablanca<\/b>, repr\u00e9sent\u00e9 par sa porte-parole Olivia Maurel<\/b>, elle-m\u00eame n\u00e9e par GPA, ainsi que par son directeur ex\u00e9cutif, Bernard Garcia<\/b>, docteur en droit.<\/p>\n

Les intervenants ont rappel\u00e9 un principe essentiel partag\u00e9 par l\u2019ensemble de la conf\u00e9rence :<\/p>\n

\u00ab Il n\u2019existe pas de droit \u00e0 l\u2019enfant. Mais chaque enfant poss\u00e8de des droits fondamentaux, \u00a0et ces droits ne sont ni n\u00e9gociables, ni transf\u00e9rables, ni commercialisables.<\/b> \u00bb<\/p>\n

Un appel clair adress\u00e9 \u00e0 l\u2019Union europ\u00e9enne<\/b><\/p>\n

Les participants ont appel\u00e9 l\u2019Union europ\u00e9enne \u00e0 :<\/p>\n

\u2022 Garantir que le Certificat europ\u00e9en<\/b> de parentalit\u00e9 ne permette pas la l\u00e9galisation de facto de la GPA dans les \u00c9tats qui l\u2019interdisent ;<\/p>\n

\u2022 Prot\u00e9ger le droit fondamental de l\u2019enfant \u00e0 son identit\u00e9, ses origines et sa filiation r\u00e9elle<\/b> ;<\/p>\n

\u2022 S\u2019opposer \u00e0 toute forme de marchandisation du corps humain et de l\u2019enfant<\/b> ;<\/p>\n
