{"id":5510,"date":"2024-04-23T10:58:59","date_gmt":"2024-04-23T08:58:59","guid":{"rendered":"https:\/\/declaration-surrogacy-casablanca.org\/?p=5510"},"modified":"2024-04-29T19:56:08","modified_gmt":"2024-04-29T17:56:08","slug":"surrogacy-as-a-minimum-case-of-trafficking-at-european-level","status":"publish","type":"post","link":"https:\/\/declaration-surrogacy-casablanca.org\/es\/surrogacy-as-a-minimum-case-of-trafficking-at-european-level\/","title":{"rendered":"Exploitation of surrogacy as a minimum case of trafficking at European level"},"content":{"rendered":"<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\"><i>PRESS RELEASE<\/i><\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">April 23th, 2024<\/p>\n<h4 class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\"><b>The European Parliament includes the exploitation of surrogacy as a minimum case of human trafficking<\/b><\/h4>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">On April 23, 2024, the European Parliament voted in favour of the revision of the Directive on combating trafficking in human beings, which <b>includes \u201cthe exploitation of surrogacy\u201d as a minimum case of trafficking at European level<\/b>, in the same way as slavery or forced prostitution. The directive was approved by 563 votes in favour, seven votes against and 17 abstentions [Text <a class=\"link-build-content\" href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/A-9-2023-0285-AM-002-002_EN.pdf\" target=\"_blank\" rel=\"noopener\"><u>here<\/u><\/a>].<\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">Council and European Parliament negotiators agreed to explicitly mention in the directive that the exploitation of surrogacy, forced marriage and illegal adoption are types of exploitation which fall under the scope of the definition of trafficking.<\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">At the event hosted by the European Parliamentarian <b>Francois Xavier BELLAMY, Olivia MAUREL, spokesperson of Casablanca Declaration and Bernard GARCIA LARRAIN, coordinator of the Casablanca Declaration, welcomed the inclusion of surrogate motherhood among the forms of human trafficking.<\/b><\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">\u201cThis is a market in which women\u2019s bodies are rented out and children\u2019s lives are sold\u201d, declared GARCIA LARRAIN, a market that \u201cit is estimated worth 14 billion dollars worldwide\u201d.<\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">On the other hand, MAUREL, born by surrogacy stated that GPA puts a child before the conception in the middle of a contract, a child that will be created \u201conly to be abandoned at birth\u201d. The child \u201cis ripped\u201d from his mother, the \u201conly person the baby will be looking for at birth\u201d who \u201cbrought him up for 9 months\u201d and \u201cplaced on the arms of complete strangers\u201d denounced MAUREL.<\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\"><b>Concerning the terms \u201cexploitation of surrogacy\u201d<\/b><\/p>\n<ul>\n<li>As GARCIA LARRAIN said, \u201c<b>it is hard to see how surrogacy could not be considered exploitation<\/b>\u201d, given that the directive itself specifies that \u00aba situation of vulnerability means that the person concerned has no real or acceptable choice but to submit to this abuse\u00bb (art. 2, 2\u00b0), which is the case for most women who undergo surrogacy.<\/li>\n<li>Also, added LARRAIN, the directive specifies that the consent of a victim of trafficking in human beings to the exploitation is \u201cirrelevant\u201d.<\/li>\n<li>On the other side, LARRAIN also considered that the fact remains that \u201cfor the child, surrogacy is always against his rights\u201d so the Casablanca Declaration regrets the inclusion of the exception concerning surrogacy about the exploitation of children.<\/li>\n<li>As MAUREL stated, children rights are always forgotten.<\/li>\n<\/ul>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\"><b>The Casablanca Declaration<\/b> considers that the unique way to respect the children\u2019s rights and women\u2019s rights is the Abolition of Surrogacy with an International Convention. <b>For the child, it is always against his dignity and rights<\/b>. For the women, they are used and exploited even with consent. However, we rejoice that the link between surrogacy and human trafficking has finally been made official at the European level.<\/p>\n<p class=\"text-build-content\" data-testid=\"ui7_tSK5_zZGNgj7jnTcR\">The Casablanca Declaration for the Abolition of Surrogacy has been signed by more than 100 experts from 75 countries around the world from different sensitivities and proposes an International Convention banning the practice of surrogacy on a global level.
