{"id":710,"date":"2023-11-21T22:39:43","date_gmt":"2023-11-21T21:39:43","guid":{"rendered":"https:\/\/declaration-surrogacy-casablanca.org\/?p=710"},"modified":"2025-02-17T23:03:04","modified_gmt":"2025-02-17T22:03:04","slug":"conference-internationale-sur-la-gpa-au-parlement-tcheque","status":"publish","type":"post","link":"https:\/\/declaration-surrogacy-casablanca.org\/es\/conference-internationale-sur-la-gpa-au-parlement-tcheque\/","title":{"rendered":"International conference about surrogacy at the Czech Parliament"},"content":{"rendered":"\r\n<p>On 2023 November 21, an international conference on surrogacy was held at the Parliament of the Czech Republic, on the initiative of three female members of parliament: Ms Romana B\u011blohl\u00e1vkov\u00e1, Ms Nina Nov\u00e1kov\u00e1 and Ms Pavla Golasowsk\u00e1.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>The first part was devoted to international speeches, including the following:<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022\u00a0<strong>Olivia Maurel, a young woman born of surrogate motherhood (<a href=\"https:\/\/declaration-surrogacy-casablanca.org\/wp-content\/uploads\/2025\/02\/2023-prague-olivia-maurel-testimony.pdf\">Olivia&#8217;s testimony HERE<\/a>)<\/strong>,<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022\u00a0<strong>Aude Mirkovic, lecturer in private law<\/strong>\u00a0<strong>and member of the non-governmental organization \u00ab Juristes pour l&#8217;enfance \u00bb,<\/strong><\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022\u00a0<strong>Bernard Garcia, doctor of law and coordinator of the Casablanca Declaration<\/strong>.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>Olivia was born of a surrogacy performed by French parents in the United States (<a href=\"https:\/\/declaration-surrogacy-casablanca.org\/wp-content\/uploads\/2025\/02\/2023-prague-olivia-maurel-testimony.pdf\">Olivia&#8217;s testimony HERE<\/a>).<\/strong>\u00a0Based on her own story, she explains how she has always suffered from the wound of abandonment caused by the \u00a0separation from her birth mother.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 For her, surrogacy is always harmful to the child, even in cases such as hers, where the surrogacy went \u00abwell\u00bb in terms of the criteria considered to be those of a \u00abgood\u00bb surrogacy: a surrogacy carried out in the United States, well-off intended parents able to provide their daughter with good educational conditions, no disputes either during the pregnancy or at birth between the surrogate mother and her intended parents.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 And yet, Olivia, the child born of this \u00absuccessful\u00bb surrogacy, has suffered a lifetime of anxiety, depression and addiction caused by this abandonment, and now finds that the weight of this burden is being passed on to the next generation, not sparing her own children.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 Her message to members of parliament is clear: there is no such thing as a good surrogacy, and there is never any justification for forcing a child to be born in order to separate it from its birth mother.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 It doesn&#8217;t matter whether or not the birth mother is genetically linked to the child, because the child doesn&#8217;t have the capacity for this kind of reflection: the woman who bore him is the only one he knows, and separation leaves him with an unfathomable void that the intended parents are unable to fill, no matter how devoted they may be.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>Legal expert Aude Mirkovic is a lecturer in private law<\/strong>. She explains that surrogacy leads to harm the child, in all surrogacies and whatever the modalities:<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 damage to the dignity of the child, who is treated as an object since he or she is ordered and handed over;<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 the infringement of the child&#8217;s filiation, since his or her maternal filiation is split up, divided between several women and sometimes even completely evicted when the sponsors are men, alone or in a couple;<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 exposing the child to the traumatic shock of separation from the woman who bore her ;<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 This is why no framework can make surrogacy acceptable, because the very principle of surrogacy violates the rights of the child.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 Protecting children born of surrogacy is a laudable objective, but it in no way prevents us from fighting surrogacy. On the contrary, combating this practice is the only effective way to protect children, because once surrogacy has been carried out, there is no truly satisfactory \u00absolution\u00bb for the child.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>Bernard Garcia, coordinator of the Casablanca Declaration<\/strong>, stresses the international dimension of the issue.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 All countries are affected by the expansion of the surrogacy market, even though most prohibit the practice, because clinics and agencies come to their countries to offer their services, and their nationals travel abroad programs to procure a child through surrogacy.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>\u2022 This international market requires a global response. The main principles and texts of international law can easily be interpreted as prohibiting surrogacy.
