On June 30 2025, Olivia Maurel, spokesperson for the Casablanca Declaration, has delivered a statement on surrogacy during the 59th session of the Human Rights Council, on the occasion of the adoption of the Universal Periodic Review (UPR) of Italy<\/b> (statement text below).<\/p>\n

The Universal Periodic Review (UPR) is a mechanism of the Human Rights Council that encourages each Member State to undergo a peer review of its human rights record every four and a half years.<\/p>\n

As part of its review, Italy received the following recommendation from Argentina on 20 January 2025: \u201cIntensify efforts to combat the emerging scourge of child trafficking through commercial surrogacy, which constitutes an affront to human dignity<\/b>\u201d (See HERE<\/u><\/a>).<\/p>\n

This recommendation is historic, as it marks the first time that surrogacy has been addressed in a UPR recommendation.<\/p>\n

While emphasizing that the violation of dignity occurs in all forms of surrogacy, not only in commercial ones, the Casablanca Declaration thanks Italy for accepting this recommendation,<\/b> thereby reaffirming its commitment to the legislative reform that seeks to criminalize surrogacy, including when pursued abroad by Italian citizens, making it a universal crime, regardless of where it is committed.<\/p>\n

Olivia Maurel declares:<\/i><\/p>\n

\u201cAs someone born through surrogacy<\/b>, torn from my mother at birth, I know in my very flesh what it means to be treated like a product. Today, through this video statement, I lend my voice to those who are never heard:<\/b> the children born under contract, the mothers reduced to their wombs, the women exploited in the name of someone else\u2019s desire.<\/i><\/p>\n

I thank Italy <\/b>for having the courage to recognize this reality and for making the fight against surrogacy a political and legal priority. What Italy is doing today is setting a moral compass in the face of a global procreation market spinning out of control.<\/i><\/p>\n

Every child has the right to be born for themselves, not to fulfill someone else\u2019s wish.<\/i><\/p>\n

I call on all States <\/b>that care about human rights: follow Italy\u2019s lead. Refuse the use of women. Refuse the fabrication, relocation, and delivery of children.\u201d<\/i><\/p>\n

Dozens and dozens of NGOs <\/b>committed to human rights, particularly the rights of women and children, from all over the world and in all languages, have formally endorsed the statement<\/b> delivered by Olivia Maurel.<\/p>\n

Aujourd\u2019hui 30 juin 2025, Olivia Maurel, porte-parole de la D\u00e9claration de Casablanca, a fait une d\u00e9claration sur la gestation pour autrui lors de la 59e session du Conseil des droits de l\u2019homme<\/b> consacr\u00e9e \u00e0 l\u2019adoption de l\u2019Examen p\u00e9riodique universel de l\u2019Italie (texte de la D\u00e9claration ci-dessous).<\/p>\n

L\u2019Examen p\u00e9riodique universel (EPU) est un m\u00e9canisme du Conseil des droits de l\u2019homme qui incite chaque \u00c9tat Membre \u00e0 proc\u00e9der tous les 4 ans et demi \u00e0 une \u00e9valuation par les pairs, autrement dit les autres pays, de son bilan en mati\u00e8re de droits de l\u2019homme<\/b>.<\/p>\n

Dans le cadre de son examen, l\u2019Italie a re\u00e7u le 20 janvier 2025 de l\u2019Argentine la recommandation suivante sur la gestation pour autrui :<\/b><\/p>\n

\u00ab Intensifier la lutte contre le nouveau fl\u00e9au de la traite des enfants par la gestation pour autrui commerciale, qui constitue une atteinte \u00e0 la dignit\u00e9 humaine \u00bb<\/b> (voir ICI<\/u><\/a>) .<\/p>\n

Cette recommandation est historique : c\u2019est la premi\u00e8re fois qu\u2019une recommandation est formul\u00e9e sur le sujet de la GPA dans le cadre de l\u2019EPU.<\/p>\n

Tout en soulignant que l\u2019atteinte \u00e0 la dignit\u00e9 r\u00e9sulte de toute GPA, et non seulement de la GPA commerciale, la D\u00e9claration de Casablanca remercie l\u2019Italie d\u2019avoir accept\u00e9 cette recommandation<\/b>, manifestant ainsi sa volont\u00e9 de pers\u00e9v\u00e9rer dans l\u2019action engag\u00e9e par la r\u00e9forme de la loi italienne, pour sanctionner le recours \u00e0 la GPA par des Italiens y compris \u00e0 l\u2019\u00e9tranger, faisant ainsi de la GPA un crime universel, quel que soit le lieu o\u00f9 il est commis.<\/p>\n

\u00ab En tant qu\u2019enfant n\u00e9e par gestation pour autrui, arrach\u00e9e \u00e0 ma m\u00e8re \u00e0 la naissance, je sais dans ma chair ce que signifie \u00eatre trait\u00e9e comme un produit. Aujourd\u2019hui, \u00e0 travers cette d\u00e9claration vid\u00e9o, je pr\u00eate ma voix \u00e0 tous ceux qu\u2019on n\u2019\u00e9coute pas :<\/b> les enfants n\u00e9s sous contrat, les m\u00e8res r\u00e9duites \u00e0 leur ut\u00e9rus, les femmes exploit\u00e9es au nom du d\u00e9sir d\u2019autrui.<\/i><\/p>\n

Je remercie l\u2019Italie<\/b> d\u2019avoir eu le courage de reconna\u00eetre cela et de faire de la lutte contre la GPA une priorit\u00e9 politique et juridique. Ce que l\u2019Italie fait aujourd\u2019hui, c\u2019est poser une boussole morale face \u00e0 un march\u00e9 mondial de la procr\u00e9ation devenu hors de contr\u00f4le.<\/i><\/p>\n

Chaque enfant a le droit de na\u00eetre pour lui-m\u00eame, pas pour r\u00e9pondre au d\u00e9sir d\u2019un autre.<\/i><\/p>\n

J\u2019en appelle \u00e0 tous les \u00c9tats attach\u00e9s aux droits humains : embo\u00eetez le pas de l\u2019Italie. Refusez que des femmes soient utilis\u00e9es et que des enfants soient fabriqu\u00e9s, d\u00e9plac\u00e9s, livr\u00e9s.<\/b> \u00bb<\/i><\/p>\n

Statement by Olivia Maurel, spokesperson for the Casablanca Declaration<\/b><\/p>\n

Mister President,<\/p>\n

Juristes Pour L\u2019Enfance, on behalf of NGOs from all over the world, welcomes Italy\u2019s acceptance of a recommendation from Argentina to fight the surrogacy market.<\/p>\n

While we regret that not all forms of surrogacy were mentioned in the recommendation, we are pleased that surrogacy, a global market experiencing a substantial growth, is receiving increased attention at the Human Rights Council. Indeed, Reem Alsalem, the UN Special Rapporteur on violence against women and girls, is currently working on a report on surrogacy and its connection to violence against women and girls for the upcoming UN General Assembly session.<\/p>\n

Surrogacy constitutes a blatant violation of the Convention on the Rights of the Child. In particular, the rights of every child: to know his or her parents and to be cared by them, to preserve their identity, to be protected against illicit transfer, to be protected against arbitrary or illegal interference in their family life, to have safeguards in the adoption procedure and to be protected against sale for any purpose or in any form.<\/p>\n

Surrogacy involves the economic exploitation of women\u2019s reproductive capacities: it poses significant health risks during pregnancy, childbirth and postpartum. We regret that arguments of bodily autonomy are being instrumentalized to justify a practice that reduces women to instruments of production. As such, it is a practice that cannot be consented to.<\/p>\n

Mister President,<\/p>\n

The surrogacy industry perpetuates global inequalities, with wealthier individuals from developed countries seeking surrogates in developing countries.<\/p>\n

We call on States to support the Casablanca Declaration for the Universal Abolition of Surrogacy to develop a comprehensive and legally binding international instrument to end this grave practice. Evidence demonstrates that this is the only way to stop intensifying trafficking and other forms of exploitation.<\/p>\n
