Presse release, Brussels – November 14, 2025<\/i><\/p>\n

The Casablanca Expert Group for the Universal Abolition of Surrogacy welcomes the resolution adopted by the European Parliament, through the Committee on Women\u2019s Rights and Gender Equality (FEMM), condemning surrogacy as a practice based on exploitation, economic coercion and the vulnerability of women <\/b>(see the Resolution HERE<\/u><\/a>, especially \u00a7 14).<\/p>\n

The resolution calls on the European Union to take concrete measures to end all forms of surrogacy<\/b>.<\/p>\n

This position builds on previous parliamentary resolutions,<\/b>notably those of 2015 and 2017, in which the Parliament had already affirmed that surrogacy is not a reproductive right and constitutes a serious violation of the dignity of women and children.<\/p>\n

Far from being a benevolent act, the resolution frames surrogacy as a globalized market, expected to exceed USD 200 billion by 2034, built upon the economic vulnerability of women, the forced separation between mother and child, and the contractualisation of human life.<\/p>\n

\u201cA decisive milestone\u201d<\/b><\/p>\n

Olivia Maurel, speaking on behalf of the Casablanca Expert Group, states:<\/p>\n

\u201cThis resolution is a powerful message to Europe and the world: the female body and the mother-child relationship are not negotiable. It protects the most vulnerable women from economic exploitation, protects children from commodification, and reaffirms that the maternal bond is a biological and emotional right\u2014not a contractual variable.\u201d<\/p>\n

Women and children are not a market resource<\/b><\/p>\n

The resolution highlights several core points:<\/p>\n

\u2022\u2060 \u00a0\u2060Surrogacy is built upon power asymmetry and the economic vulnerability of women;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060The child becomes the object of a contract rather than a subject of rights;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060The practice fuels a global industry worth billions, operating without any universal ethical framework.<\/p>\n

In this regard, the resolution reaffirms the fundamental principle of the non-commercialisation of the human body, central to European and international law, and strengthens the protection of the maternal\u2013infant bond, essential to both physical and psychological health.<\/p>\n

A political and legal foundation for further action<\/b><\/p>\n

The text will now serve as an interpretative framework for the European Directive (EU 2024\/1712) on combating human trafficking, which explicitly refers to \u201cthe exploitation of surrogacy\u201d as a form of reproductive exploitation.<\/p>\n

This directive requires Member States to recognise and sanction all forms of exploitation linked to human reproduction, thereby providing a clear legal basis to act against surrogacy within the European Union.<\/p>\n

It may guide future legislative action<\/b>, including:<\/p>\n

\u2022\u2060 \u00a0\u2060The prohibition of all forms of surrogacy;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060The ban on advertising, agencies and intermediaries;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060Preventing circumvention through recourse to third countries.<\/p>\n

Toward international change<\/b><\/p>\n

This resolution aligns with a growing global movement reinforced by the report of Reem Alsalem, United Nations Special Rapporteur on violence against women and girls, published on 14 July 2025<\/b> (Protocol A\/HRC\/60\/45).<\/p>\n

That report calls on States to recognise surrogacy as a form of reproductive violence, and to work toward an international instrument aimed at abolishing all forms of surrogacy, including so-called \u201caltruistic\u201d models.<\/b><\/p>\n

The convergence between the European Union and the United Nations confirms that surrogacy is not social progress, but a severe violation of human rights, incompatible with justice, gender equality, and human dignity.<\/p>\n

Le Groupe d\u2019experts de Casablanca pour l\u2019abolition universelle de la gestation pour autrui salue la r\u00e9solution adopt\u00e9e hier 13 novembre 2025 par le Parlement europ\u00e9en, via la Commission des droits des femmes et de l\u2019\u00e9galit\u00e9 des genres (FEMM), condamnant la gestation pour autrui (GPA) comme une pratique fond\u00e9e sur l\u2019exploitation, la contrainte \u00e9conomique et la vuln\u00e9rabilit\u00e9 des femmes <\/b>(voir la R\u00e9solution ICI<\/u><\/a>, sp\u00e9cialement \u00a7 14).<\/p>\n

Ce texte est un appel pour l\u2019Union europ\u00e9enne \u00e0 prendre des mesures concr\u00e8tes pour mettre fin \u00e0 toutes les formes de GPA<\/b>.<\/p>\n

Cette prise de position s\u2019inscrit dans la continuit\u00e9 de plusieurs r\u00e9solutions ant\u00e9rieures<\/b>, notamment celles de 2015 et 2017, o\u00f9 le Parlement avait d\u00e9j\u00e0 affirm\u00e9 que la GPA ne constitue pas un droit reproductif et qu\u2019elle repr\u00e9sente une atteinte grave \u00e0 la dignit\u00e9 des femmes et des enfants.<\/p>\n

Loin d\u2019\u00eatre un acte solidaire, la GPA appara\u00eet dans cette r\u00e9solution comme un march\u00e9 mondialis\u00e9, estim\u00e9 \u00e0 plus de 200 milliards de dollars d\u2019ici 2034, fond\u00e9 sur la vuln\u00e9rabilit\u00e9 \u00e9conomique des femmes, la dissociation forc\u00e9e entre m\u00e8re et enfant et la contractualisation du vivant.<\/p>\n

\u00ab Une \u00e9tape d\u00e9cisive \u00bb<\/b><\/p>\n

Pour Olivia Maurel, au nom du Groupe d\u2019experts de Casablanca :<\/p>\n

\u00ab Cette r\u00e9solution est un signal fort adress\u00e9 \u00e0 l\u2019Europe et au monde : le corps des femmes et la relation maternelle ne sont pas n\u00e9gociables. Elle prot\u00e8ge les femmes les plus vuln\u00e9rables contre l\u2019exploitation \u00e9conomique, prot\u00e8ge les enfants contre la marchandisation, et rappelle que le lien materno-infantile est un droit biologique et affectif fondamental, pas une variable contractuelle. \u00bb<\/p>\n

Les femmes et les enfants ne sont pas une ressource de march\u00e9<\/b><\/p>\n

La r\u00e9solution met en lumi\u00e8re plusieurs points essentiels :<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060La GPA repose sur une asym\u00e9trie de pouvoir et sur la vuln\u00e9rabilit\u00e9 \u00e9conomique des femmes ;<\/p>\n

\u2022\u2060 \u00a0\u2060L\u2019enfant devient l\u2019objet d\u2019un contrat, et non un sujet de droits ;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060\u2060\u2060La pratique alimente une industrie mondiale estim\u00e9e \u00e0 plusieurs milliards d\u2019euros, sans aucun cadre \u00e9thique universel.<\/p>\n

En ce sens, la r\u00e9solution r\u00e9affirme le principe fondamental de non-commercialisation du corps humain, pilier du droit europ\u00e9en et international, et renforce la protection du lien entre la m\u00e8re et l\u2019enfant, essentiel \u00e0 leur sant\u00e9 physique et psychologique.<\/p>\n

Une base politique et juridique pour aller plus loin<\/b><\/p>\n

Ce texte servira d\u00e9sormais de cadre d\u2019interpr\u00e9tation pour la directive europ\u00e9enne (UE 2024\/1712) sur la lutte contre la traite des \u00eatres humains, laquelle mentionne explicitement \u201cl\u2019exploitation de la gestation pour autrui\u201d comme une forme d\u2019exploitation reproductive. Cette directive impose aux \u00c9tats membres de reconna\u00eetre et de sanctionner toutes les formes d\u2019exploitation li\u00e9es \u00e0 la reproduction humaine, offrant ainsi un levier juridique clair pour agir contre la GPA sur le territoire europ\u00e9en.<\/p>\n

Elle pourra orienter les futures \u00e9volutions l\u00e9gislatives<\/b>, notamment sur :<\/p>\n

\u2022\u2060 \u00a0\u2060l\u2019interdiction de toutes les formes de GPA ;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060l\u2019interdiction de la publicit\u00e9, des agences et de l\u2019interm\u00e9diation ;<\/p>\n

\u2022\u2060 \u00a0\u2060\u2060la pr\u00e9vention du contournement par le recours \u00e0 des pays tiers.<\/p>\n

Vers un changement international<\/b><\/p>\n

Cette r\u00e9solution s\u2019inscrit dans un mouvement mondial renforc\u00e9 par le rapport de Reem Alsalem, Rapporteuse sp\u00e9ciale des Nations Unies sur la violence contre les femmes et les filles, publi\u00e9 le 14 juillet 2025<\/b> (protocole A\/HRC\/60\/45).<\/p>\n

Ce rapport appelle les \u00c9tats \u00e0 reconna\u00eetre la GPA comme une forme de violence reproductive, et \u00e0 \u00e9laborer un instrument international visant \u00e0 abolir toutes ses formes, y compris celles dites \u00ab altruistes \u00bb<\/b>.<\/p>\n

Cette convergence entre les institutions europ\u00e9ennes et les Nations Unies<\/b> confirme que la prise de conscience progresse <\/b>sur le fait que GPA n\u2019est pas une avanc\u00e9e sociale, mais une violation grave des droits humains, contraire \u00e0 la justice, \u00e0 l\u2019\u00e9galit\u00e9 entre les sexes et \u00e0 la dignit\u00e9 humaine.<\/p>\n
