At the Dutch Parliament, Support for Surrogacy Is Being Reconsidered Following Interventions by Olivia Maurel and the UN Special Rapporteur to the United Nations.<\/b><\/p>\n<\/div>\n<\/td>\n<\/tr>\n

At the invitation of the NPV<\/b>\u00a0(Nederlandse Pati\u00ebntenvereniging),\u00a0Olivia Maurel<\/b>, spokesperson for the Casablanca Declaration and herself born through surrogacy,\u00a0addressed a conference this week at the Dutch Parliament dedicated to the human, ethical, and legal implications of surrogacy.<\/b><\/p>\n

The event brought together\u00a0Dutch parliamentarians, international experts,<\/b>\u00a0and the United Nations Special Rapporteur on violence against women and girls,\u00a0Reem Alsalem<\/b>, who participated.<\/p>\n

The conference took place at a particularly significant moment in the Netherlands.\u00a0For several years, the country has been debating legislative reforms aimed at facilitating and providing a clearer legal framework for surrogacy.<\/b>\u00a0While so-called \u201caltruistic\u201d surrogacy is already practiced under certain conditions, several proposals have been advanced to establish a more favorable legal framework for its development and for the recognition of surrogacy agreements.\u00a0These discussions have nevertheless raised growing concerns regarding the rights of women and children, as well as the risk of normalizing a global reproductive market.<\/b><\/p>\n

During the conference, Olivia Maurel shared both her personal experience and the work of the Casablanca Declaration.<\/b><\/p>\n

The conference also featured an intervention by\u00a0Reem Alsalem<\/b>, United Nations Special Rapporteur on violence against women and girls. In her report presented to the United Nations in 2025, she concluded that surrogacy, including when presented as \u201caltruistic,\u201d\u00a0raises serious human rights concerns and called for the development of an international legal instrument aimed at abolishing the practice.<\/b><\/p>\n

The conference also included a respectful discussion between Olivia Maurel and a woman who had previously served as a surrogate,\u00a0<\/b>offering parliamentarians the opportunity to consider differing perspectives on surrogacy.<\/p>\n

Following the event, several parliamentarians in attendance indicated that they had fundamentally reconsidered their position on surrogacy.<\/b>\u00a0Some stated that they had previously supported its legalization or expansion but now believed that the violations of the rights of women and children highlighted during the discussions could no longer be ignored.<\/p>\n

\u201cThe fact that policymakers are willing to change their views when they hear directly from those most affected is extremely encouraging,<\/b><\/i>\u201d said Olivia Maurel.<\/p>\n

\u201cToo often, the debate is framed solely around adults\u2019 desire to have children. But when we listen to people born through surrogacy, when we examine the realities experienced by women recruited to carry these pregnancies, and when we study the functioning of the global reproductive market, a very different reality emerges.<\/b><\/i>\u201d<\/p>\n

This intervention forms part of the international advocacy efforts of the\u00a0Casablanca Declaration<\/b>, which works toward the adoption of an international legal instrument aimed at abolishing surrogacy and protecting the fundamental rights of women and children. The coalition has already engaged with the United Nations, the European Parliament, and numerous national parliaments across Europe and Latin America.<\/p>\n

Olivia Maurel is in Poland, where she will once again join Reem Alsalem for a conference on surrogacy.<\/b><\/p>\n

Pa\u00edses Bajos: el Parlamento neerland\u00e9s reconsidera su postura sobre maternidad subrogada tras las intervenciones de Olivia Maurel y la Relatora Especial de Naciones Unidas.<\/b><\/p>\n

Invitada por la NPV\u00a0<\/b>(Nederlandse Pati\u00ebntenvereniging),\u00a0Olivia Maurel,<\/b>\u00a0portavoz de la Declaraci\u00f3n de Casablanca y nacida a trav\u00e9s de maternidad subrogada (MS),\u00a0intervino esta semana en el Parlamento neerland\u00e9s en una conferencia dedicada a los desaf\u00edos humanos, \u00e9ticos y jur\u00eddicos que posa la maternidad subrogada.<\/b><\/p>\n

El evento reuni\u00f3 a\u00a0parlamentarios neerlandeses y expertos internacionales,<\/b>\u00a0como la Relatora Especial de las Naciones Unidas sobre la violencia contra las mujeres y las ni\u00f1as,\u00a0Reem Alsalem<\/b>.<\/p>\n

Esta reuni\u00f3n tuvo lugar en un contexto especialmente relevante en los Pa\u00edses Bajos.\u00a0Desde hace varios a\u00f1os, el pa\u00eds debate una reforma destinada a facilitar y regular jur\u00eddicamente la gestaci\u00f3n subrogada.<\/b>\u00a0Si bien la denominada gestaci\u00f3n subrogada \u201caltruista\u201d ya se practica bajo determinadas condiciones, se han presentado diversas propuestas para establecer un marco jur\u00eddico m\u00e1s favorable a su desarrollo y al reconocimiento de los acuerdos que regulan esta pr\u00e1ctica. Sin embargo, estos debates suscitan una creciente preocupaci\u00f3n en relaci\u00f3n con los derechos de las mujeres y \u00a0ni\u00f1os, as\u00ed como con el riesgo de normalizar un mercado internacional de la reproducci\u00f3n.<\/p>\n

Durante la conferencia, Olivia Maurel comparti\u00f3 su propia historia, as\u00ed como el trabajo de la Declaraci\u00f3n de Casablanca.<\/b><\/p>\n

La conferencia cont\u00f3 igualmente con la intervenci\u00f3n de\u00a0Reem Alsalem,<\/b>\u00a0Relatora Especial de las Naciones Unidas sobre la violencia contra las mujeres y las ni\u00f1as. En su informe presentado a las Naciones Unidas en 2025, concluy\u00f3 que la maternidad subrogada, incluso cuando se presenta como \u201caltruista\u201d,\u00a0plantea serias preocupaciones en materia de derechos humanos y pidi\u00f3 la elaboraci\u00f3n de un instrumento internacional destinado a abolir esta pr\u00e1ctica.<\/b><\/p>\n

La conferencia dio lugar asimismo a\u00a0un debate respetuoso entre Olivia Maurel y una mujer que hab\u00eda sido madre gestante,<\/b>\u00a0ofreciendo a los parlamentarios presentes la oportunidad de escuchar puntos de vista contrastados sobre la maternidad subrogada.<\/p>\n

Al t\u00e9rmino del encuentro, varios parlamentarios presentes indicaron haber reconsiderado profundamente su posici\u00f3n sobre la gestaci\u00f3n subrogada.<\/b>\u00a0Algunos declararon que anteriormente eran favorables a su legalizaci\u00f3n o desarrollo, pero que ahora consideran que las vulneraciones de los derechos de las mujeres y ni\u00f1os que se pusieron de relieve durante el debate ya no pueden ser ignoradas.<\/p>\n

\u00abEl hecho de que los responsables pol\u00edticos puedan cambiar de opini\u00f3n cuando escuchan a las personas directamente afectadas es sumamente alentador<\/b><\/i>\u00bb, declar\u00f3 Olivia Maurel.<\/p>\n

\u00abCon demasiada frecuencia, el debate se plantea \u00fanicamente desde la perspectiva del deseo de los adultos de tener hijos. Pero cuando se escucha a las personas nacidas mediante gestaci\u00f3n subrogada, cuando se examina la realidad vivida por las mujeres reclutadas para llevar estos embarazos y cuando se estudia el funcionamiento del mercado mundial de la reproducci\u00f3n, emerge una realidad muy diferente<\/b><\/i>\u00bb.<\/p>\n

Esta intervenci\u00f3n se enmarca en las actividades internacionales de la Declaraci\u00f3n de Casablanca, que trabaja por la adopci\u00f3n de un instrumento jur\u00eddico internacional destinado a abolir la gestaci\u00f3n subrogada y a proteger los derechos fundamentales de las mujeres y de los ni\u00f1os. La coalici\u00f3n ya ha intervenido ante las Naciones Unidas, el Parlamento Europeo, as\u00ed como en numerosos parlamentos nacionales en Europa y Am\u00e9rica Latina.<\/p>\n

Olivia estar\u00e1 en Polonia esta semana junto a Reem Alsalem, nuevamente para una conferencia sobre la gestaci\u00f3n subrogada.<\/b><\/p>\n

\u00c0 l’invitation de la NPV<\/b>\u00a0(Nederlandse Pati\u00ebntenvereniging),\u00a0Olivia Maurel,<\/b>\u00a0porte-parole de la D\u00e9claration de Casablanca et n\u00e9e elle-m\u00eame d’une gestation pour autrui (GPA), est intervenue cette semaine au\u00a0Parlement n\u00e9erlandais lors d’une conf\u00e9rence consacr\u00e9e aux enjeux humains, \u00e9thiques et juridiques de la GPA.<\/b><\/p>\n

L’\u00e9v\u00e9nement a r\u00e9uni des\u00a0parlementaires n\u00e9erlandais, des experts internationaux<\/b>\u00a0ainsi que la Rapporteuse sp\u00e9ciale des Nations unies sur la violence contre les femmes et les filles,\u00a0Reem Alsalem<\/b>, qui est intervenue.<\/p>\n

Cette rencontre s’est tenue dans un contexte particuli\u00e8rement important aux Pays-Bas.\u00a0Depuis plusieurs ann\u00e9es, le pays d\u00e9bat d’une r\u00e9forme visant \u00e0 faciliter et encadrer juridiquement la GPA.\u00a0<\/b>Si la GPA dite \u00ab altruiste \u00bb est d\u00e9j\u00e0 pratiqu\u00e9e sous certaines conditions, plusieurs propositions ont \u00e9t\u00e9 avanc\u00e9es afin de cr\u00e9er un cadre l\u00e9gal plus favorable \u00e0 son d\u00e9veloppement et \u00e0 la reconnaissance des accords de GPA. Ces discussions suscitent toutefois des inqui\u00e9tudes croissantes quant aux droits des femmes et des enfants ainsi qu’au risque de normalisation d’un march\u00e9 international de la reproduction.<\/p>\n

Au cours de la conf\u00e9rence, Olivia Maurel a partag\u00e9 son histoire personnelle ainsi que les travaux de la D\u00e9claration de Casablanca.\u00a0<\/b><\/p>\n

La conf\u00e9rence a \u00e9galement b\u00e9n\u00e9fici\u00e9 de l’intervention de\u00a0Reem Alsalem,<\/b>\u00a0Rapporteuse sp\u00e9ciale des Nations unies sur la violence contre les femmes et les filles. Dans son rapport pr\u00e9sent\u00e9 aux Nations unies en 2025, elle a conclu que la gestation pour autrui, y compris lorsqu’elle est pr\u00e9sent\u00e9e comme \u00ab altruiste \u00bb,\u00a0soul\u00e8ve de graves pr\u00e9occupations en mati\u00e8re de droits humains et a appel\u00e9 \u00e0 l’\u00e9laboration d’un instrument international visant \u00e0 abolir cette pratique.<\/b><\/p>\n

La conf\u00e9rence a \u00e9galement donn\u00e9 lieu \u00e0 un\u00a0d\u00e9bat respectueux entre Olivia Maurel et une femme ayant \u00e9t\u00e9 m\u00e8re porteuse<\/b>, offrant aux parlementaires pr\u00e9sents l’opportunit\u00e9 d’entendre des points de vue oppos\u00e9s sur la GPA.<\/p>\n

\u00c0 l’issue de la rencontre, plusieurs parlementaires pr\u00e9sents ont indiqu\u00e9 avoir profond\u00e9ment reconsid\u00e9r\u00e9 leur position sur la GPA.\u00a0<\/b>Certains ont d\u00e9clar\u00e9 qu’ils \u00e9taient auparavant favorables \u00e0 sa l\u00e9galisation ou \u00e0 son d\u00e9veloppement mais qu’ils consid\u00e9raient d\u00e9sormais que les atteintes aux droits des femmes et des enfants soulev\u00e9es durant les \u00e9changes ne pouvaient \u00eatre ignor\u00e9es.<\/p>\n

\u00ab\u00a0Le fait que des responsables politiques puissent changer d’avis lorsqu’ils entendent les personnes directement concern\u00e9es est extr\u00eamement encourageant\u00a0<\/b><\/i>\u00bb, a d\u00e9clar\u00e9 Olivia Maurel.<\/p>\n

\u00ab\u00a0Trop souvent, le d\u00e9bat est pr\u00e9sent\u00e9 uniquement sous l’angle du d\u00e9sir d’enfant des adultes. Mais lorsqu’on \u00e9coute les enfants n\u00e9s de GPA, lorsqu’on examine la r\u00e9alit\u00e9 v\u00e9cue par les femmes recrut\u00e9es pour porter ces grossesses et lorsqu’on \u00e9tudie le fonctionnement du march\u00e9 mondial de la reproduction, une autre r\u00e9alit\u00e9 appara\u00eet.\u00a0<\/b><\/i>\u00bb<\/p>\n

Cette intervention s’inscrit dans le cadre des activit\u00e9s internationales de la D\u00e9claration de Casablanca, qui \u0153uvre pour l’adoption d’un instrument juridique international visant \u00e0 abolir la gestation pour autrui et \u00e0 prot\u00e9ger les droits fondamentaux des femmes et des enfants. La coalition est d\u00e9j\u00e0 intervenue aupr\u00e8s des Nations unies, du Parlement europ\u00e9en ainsi que de nombreux parlements nationaux en Europe et en Am\u00e9rique latine.<\/p>\n

Olivia est en Pologne cette semaine aux cot\u00e9s de Reem Alsalem \u00e0 nouveau pour une conf\u00e9rence sur la GPA.<\/b><\/p>\n

The Declaration of Casablanca makes the following recommendations to the States<\/b><\/p>\n

\u2022 Deny any legal validity to contracts bearing the undertaking from a woman\u00a0to\u00a0carry and deliver a child<\/p>\n

\u2022 Punish individuals and corporations acting as intermediaries between the surrogacy mothers and the orderers<\/p>\n

\u2022 Prosecute individuals who have recourse to a surrogate mother on their territory<\/p>\n

\u2022 Prosecute their nationals who have recourse to a surrogate mother outside their territory<\/p>\n

\u2022 Act in favor of the implementation of a legal instrument bearing global prohibition of the surrogacy.<\/p>\n
