Warsaw: Olivia Maurel Speaks Alongside UN Special Rapporteur Reem Alsalem at International Conference on Motherhood and Surrogacy<\/b><\/p>\n<\/div>\n<\/td>\n<\/tr>\n

Olivia Maurel, spokesperson for the Casablanca Declaration and a person born through surrogacy, spoke today in Warsaw at the international scientific conference \u201cMotherhood in the 21st Century: Support and Protection Policies in the Face of Challenges and Threats<\/b>\u201d, organized by Cardinal Stefan Wyszy\u0144ski University.<\/p>\n

On this occasion, she participated in a panel discussion on the legal, psychological, and ethical dimensions of surrogacy alongside\u00a0Reem Alsalem<\/b>, United Nations Special Rapporteur on violence against women and girls, as well as\u00a0international experts\u00a0<\/b>from the legal, medical, and academic fields.<\/p>\n

This latest joint appearance, following a similar intervention in the Netherlands last week, comes only a few months after Reem Alsalem’s landmark presentation of her report to the United Nations, which concluded that surrogacy constitutes a form of reproductive exploitation incompatible with the fundamental rights of women and children.<\/p>\n

Addressing more than one hundred participants, including politicians, scientists, and legal experts, Olivia Maurel emphasized that discussions on surrogacy are too often centered on adults\u2019 desires, while the primary stakeholders remain the children themselves.<\/p>\n

\u201cWe need to shift the focus. The question is not how far we are willing to go to satisfy a desire for a child. The question is which rights we are willing to take away from children in order to satisfy that desire.<\/b>\u201d<\/p>\n

The joint participation of Olivia Maurel and Reem Alsalem reflects the growing convergence between the testimonies of people born through surrogacy, human rights organizations, and international experts who are raising concerns about the consequences of this rapidly expanding global industry.<\/p>\n

Only months after calling on States, in her report to the United Nations, to work toward the universal abolition of surrogacy,\u00a0Reem Alsalem reiterated today in Warsaw the need for an international response grounded in the fundamental rights of children.<\/b>\u00a0Her intervention marks an important step in the growing recognition among international human rights experts that no child should be conceived under a contract providing for their transfer to third parties at birth.<\/p>\n

The Casablanca Declaration<\/b>, which brings together more than 150 experts from diverse political, philosophical, and religious backgrounds, continues to advocate for an international legal instrument aimed at abolishing surrogacy and ensuring respect for the fundamental rights of children, including their right to identity, their origins, and their right not to be the object of a transaction or contractual arrangement.<\/p>\n

Olivia Maurel, portavoz de la Declaraci\u00f3n de Casablanca y nacida mediante gestaci\u00f3n subrogada, intervino hoy en Varsovia en la conferencia cient\u00edfica internacional \u201cLa maternidad en el siglo XXI: pol\u00edticas de apoyo y de protecci\u00f3n frente a los desaf\u00edos y las amenazas<\/b>\u201d, organizada por la Universidad Cardinal Stefan Wyszy\u0144ski.<\/p>\n

En esta ocasi\u00f3n, particip\u00f3 en un panel dedicado a las dimensiones jur\u00eddicas, psicol\u00f3gicas y \u00e9ticas de la maternidad subrogada junto a\u00a0Reem Alsalem<\/b>, Relatora Especial de las Naciones Unidas sobre la violencia contra las mujeres y las ni\u00f1as, as\u00ed como a\u00a0expertos internacionales<\/b>\u00a0del \u00e1mbito jur\u00eddico, m\u00e9dico y acad\u00e9mico.<\/p>\n

Esta nueva intervenci\u00f3n conjunta, al igual que la realizada en los Pa\u00edses Bajos la semana pasada, se produce pocos meses despu\u00e9s de la presentaci\u00f3n hist\u00f3rica ante las Naciones Unidas del informe de Reem Alsalem, que concluye que la gestaci\u00f3n subrogada constituye una forma de explotaci\u00f3n reproductiva incompatible con los derechos fundamentales de las mujeres y los ni\u00f1os.<\/p>\n

Ante m\u00e1s de un centenar de participantes, entre ellos pol\u00edticos, cient\u00edficos y juristas, Olivia Maurel record\u00f3 que el debate sobre la maternidad subrogada est\u00e1 demasiado a menudo centrado en el deseo de los adultos, mientras que los principales afectados siguen siendo los ni\u00f1os.<\/p>\n

\u00abDebemos cambiar la perspectiva. La cuesti\u00f3n no es hasta d\u00f3nde estamos dispuestos a llegar para satisfacer un deseo de tener un hijo. La cuesti\u00f3n es qu\u00e9 derechos estamos dispuestos a retirar a los ni\u00f1os para satisfacer el deseo.<\/b><\/i>\u00bb<\/p>\n

La presencia conjunta de Olivia Maurel y Reem Alsalem ilustra la creciente convergencia entre los testimonios de personas nacidas mediante gestaci\u00f3n subrogada, las organizaciones de defensa de los derechos humanos y los expertos internacionales que alertan sobre las consecuencias de esta industria mundial en plena expansi\u00f3n.<\/p>\n

A los pocos meses de haber instado a los Estados a trabajar por la abolici\u00f3n universal de la gestaci\u00f3n subrogada en su informe ante las Naciones Unidas,\u00a0Reem Alsalem reiter\u00f3 hoy en Varsovia la necesidad de una respuesta internacional basada en los derechos fundamentales de los ni\u00f1os.\u00a0<\/b>Su intervenci\u00f3n marca un hito importante en el creciente reconocimiento, por parte de los expertos internacionales en derechos humanos, de que ning\u00fan ni\u00f1o deber\u00eda ser concebido en el marco de un contrato que prevea su entrega a terceros desde el nacimiento.<\/p>\n

La Declaraci\u00f3n de Casablanca,<\/b>\u00a0que re\u00fane a m\u00e1s de 150 expertos de diversos \u00e1mbitos pol\u00edticos, filos\u00f3ficos y religiosos, contin\u00faa su misi\u00f3n de abogar por la adopci\u00f3n de un instrumento internacional destinado a abolir la maternidad subrogada y a garantizar el respeto de los derechos fundamentales de los ni\u00f1os, incluido su derecho a la identidad, a sus or\u00edgenes y a no ser objeto de una transacci\u00f3n o de un contrato.<\/p>\n

Olivia Maurel, porte-parole de la D\u00e9claration de Casablanca et enfant n\u00e9e par gestation pour autrui (GPA), est intervenue aujourd\u2019hui \u00e0 Varsovie lors de la conf\u00e9rence scientifique internationale \u00ab\u00a0La maternit\u00e9 au XXIe si\u00e8cle : politiques de soutien et de protection face aux d\u00e9fis et aux menaces\u00a0<\/b>\u00bb, organis\u00e9e \u00e0 l\u2019Universit\u00e9 Cardinal Stefan Wyszy\u0144ski.<\/p>\n

\u00c0 cette occasion, elle a particip\u00e9 \u00e0 un panel consacr\u00e9 aux dimensions juridiques, psychologiques et \u00e9thiques de la GPA aux c\u00f4t\u00e9s de\u00a0Reem Alsalem<\/b>, Rapporteuse sp\u00e9ciale des Nations Unies sur la violence contre les femmes et les filles, ainsi que\u00a0d\u2019experts internationaux\u00a0<\/b>issus du monde juridique, m\u00e9dical et universitaire.<\/p>\n

Cette nouvelle intervention commune, tout comme celle faite en Hollande la semaine derni\u00e8re, intervient quelques mois seulement apr\u00e8s la pr\u00e9sentation historique devant les Nations Unies du rapport de Reem Alsalem concluant que la gestation pour autrui constitue une forme d\u2019exploitation reproductive incompatible avec les droits fondamentaux des femmes et des enfants.<\/p>\n

Devant plus d’une centaine de participants, Olivia Maurel a rappel\u00e9 que le d\u00e9bat sur la GPA est trop souvent centr\u00e9 sur le d\u00e9sir des adultes alors que les premiers concern\u00e9s demeurent les enfants.<\/p>\n

\u00ab\u00a0Nous devons d\u00e9placer le regard. La question n\u2019est pas de savoir jusqu\u2019o\u00f9 nous sommes pr\u00eats \u00e0 aller pour satisfaire un d\u00e9sir d\u2019enfant. La question est de savoir quels droits nous sommes pr\u00eats \u00e0 retirer aux enfants pour satisfaire ce d\u00e9sir.\u00a0<\/b><\/i>\u00bb<\/p>\n

La pr\u00e9sence conjointe d\u2019Olivia Maurel et de Reem Alsalem illustre la convergence croissante entre les t\u00e9moignages de personnes n\u00e9es par GPA, les organisations de d\u00e9fense des droits humains et les experts internationaux qui alertent sur les cons\u00e9quences de cette industrie mondiale en pleine expansion.<\/p>\n

Quelques mois apr\u00e8s avoir appel\u00e9 les \u00c9tats \u00e0 \u0153uvrer \u00e0 l\u2019abolition universelle de la gestation pour autrui dans son rapport aux Nations Unies,\u00a0Reem Alsalem a r\u00e9it\u00e9r\u00e9 aujourd\u2019hui \u00e0 Varsovie la n\u00e9cessit\u00e9 d\u2019une r\u00e9ponse internationale fond\u00e9e sur les droits fondamentaux des enfants.<\/b>\u00a0Son intervention marque une \u00e9tape importante dans la reconnaissance croissante, par les experts internationaux des droits humains, du fait qu\u2019aucun enfant ne devrait \u00eatre con\u00e7u dans le cadre d\u2019un contrat pr\u00e9voyant sa remise \u00e0 des tiers d\u00e8s sa naissance.<\/p>\n

La D\u00e9claration de Casablanca<\/b>, qui rassemble plus de 150 experts de tous horizons politiques, philosophiques et religieux, poursuit son plaidoyer en faveur d\u2019un instrument international visant \u00e0 abolir la GPA et \u00e0 garantir le respect des droits fondamentaux des enfants, notamment leur droit \u00e0 leur identit\u00e9, \u00e0 leurs origines et \u00e0 ne pas faire l\u2019objet d\u2019une transaction ou d\u2019un contrat.<\/p>\n

The Declaration of Casablanca makes the following recommendations to the States<\/b><\/p>\n

\u2022 Prohibit surrogacy on their territory<\/p>\n

\u2022 Deny any legal validity to contracts bearing the undertaking from a woman\u00a0to\u00a0carry and deliver a child<\/p>\n

\u2022 Punish individuals and corporations acting as intermediaries between the surrogacy mothers and the orderers<\/p>\n

\u2022 Prosecute individuals who have recourse to a surrogate mother on their territory<\/p>\n

\u2022 Prosecute their nationals who have recourse to a surrogate mother outside their territory<\/p>\n

\u2022 Act in favor of the implementation of a legal instrument bearing global prohibition of the surrogacy.<\/p>\n
